McLean Quarry Update (11/06)
CCC remains involved as it has for a long time with the proposed McLean Quarry. The McLean Motion for Reconsideration and its sudden Motion to Dismiss are still pending in the Environmental Court. Also pending are objections and requests made by various community members who are involved in opposing McLean’s earlier attempt to site a single quarry on the north side of its property at the end of Tierney Rd. Should the Court allow McLean to withdraw its application under the circumstances requested by the opposition, it should mean the end of this protracted and contentious proceeding. Meanwhile, in a separate action, the waste water permit for the proposed quarry has been turned down. Also, a recent Supreme Court case ruled that once a project has been turned down it cannot come back for another bite at the apple unless the redesign eliminates the problems that had been identified earlier. This is a help for communities who find themselves in what can seem an endless struggle to protect themselves from unsound business practices. CCC continues to monitor the process of the case and will remain active as needed.
